Why you'd use this
Before an employer gets a background report for employment purposes, the Fair Credit Reporting Act requires two things: a clear and conspicuous written disclosure, in a document that consists solely of the disclosure, and the person's written authorization.
The stand-alone rule is where small employers most often go wrong. Liability waivers, application questions, or extra legal terms on the disclosure page have been the basis of many FCRA lawsuits. This generator keeps the disclosure on its own page and puts the authorization on a separate page, with optional state notices on a third.

What belongs on the disclosure, and what does not
- Belongs: that a consumer report may be obtained for employment purposes, what it may include, and who will prepare it.
- Does not belong: liability releases, at-will statements, application questions, or anything unrelated to the disclosure.
- The authorization can be a separate page that the person signs and dates.
Contractors count too
If you screen independent contractors or gig workers, use the same process. The FTC has treated contractor screening as an employment purpose under the FCRA.

Questions people ask about this
Does the FCRA disclosure have to be a separate document?
Yes. The FCRA requires the disclosure to be in a document that consists solely of the disclosure. The authorization may be on the same page under the statute, but keeping it separate avoids mixing in extra language.
Can I include a liability waiver on the disclosure?
No. Courts have found that extra terms like liability waivers violate the stand-alone requirement.
Do I need to give the Summary of Rights with the disclosure?
Give the CFPB's Summary of Your Rights Under the FCRA with the disclosure, and again with any pre-adverse action notice. Some states also require it at specific points.
Do PreHireBadge customers need this template?
Not for PreHireBadge orders. The candidate's invite presents the stand-alone disclosure, state notices, and authorization, and stores the signed consent. The template is for anyone running their own process.
General information only, not legal advice. Using this tool does not make a process compliant on its own, and federal, state, and city rules differ and change. An employment lawyer can apply them to your facts.
