1. Description of Service

PreHireBadge provides employers with tools to request and manage FCRA-compliant pre-employment background checks, including criminal record searches, identity verification, address history, and related candidate management features. PreHireBadge acts as a consumer reporting agency, as that term is defined under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq., when furnishing consumer reports.

2. Eligibility and Account Responsibilities

• You must be at least 18 years old and able to form a binding contract to use PreHireBadge.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current information when creating an account or submitting a screening request.

3. Employer Obligations

If you use PreHireBadge to request background checks on job candidates or employees, you represent and agree that you will:

• Have a permissible purpose under the FCRA for every report you request.
• Provide candidates with a clear, standalone written disclosure and obtain their written authorization before requesting a report.
• Follow the FCRA's adverse action process — including a pre-adverse action notice, a reasonable waiting period, and a final adverse action notice — before taking any adverse action based on a report.
• Comply with all applicable federal, state, and local laws governing background checks and hiring, including ban-the-box and fair-chance hiring ordinances where applicable.
• Not use PreHireBadge or any report obtained through it to discriminate against a candidate on the basis of a protected characteristic.

You are solely responsible for your hiring decisions. PreHireBadge furnishes consumer reports but does not make, and is not responsible for, any employment decision.

4. Fees and Payment

Background check pricing is displayed on our Pricing page and is subject to change with notice. Fees are charged per report requested. Purchased credits do not expire but are non-refundable except where a report cannot be completed or verified to FCRA standards, in which case the associated credit will be refunded or reissued.

5. Acceptable Use

• Use PreHireBadge to obtain a report on yourself, a family member, or any individual without a legitimate employment-related permissible purpose and proper authorization.
• Use the platform to violate any applicable law, including federal, state, or local employment and consumer protection law.
• Attempt to interfere with, disrupt, or gain unauthorized access to the platform or its underlying systems.
• Resell, sublicense, or provide access to the platform to any third party without our written consent.

6. Disclaimers

Background check reports are compiled from third-party public records and databases. While PreHireBadge takes commercially reasonable steps to maintain accuracy, we do not guarantee that every report is complete or error-free. PreHireBadge is provided “as is” without warranties of any kind, express or implied, to the fullest extent permitted by law.

7. Limitation of Liability

To the fullest extent permitted by law, ScreenForge Labs, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of PreHireBadge, including any hiring decision made in reliance on a report. Nothing in these Terms limits liability that cannot be limited under the FCRA or other applicable law.

8. Termination

We may suspend or terminate access to PreHireBadge for any account that violates these Terms or applicable law. You may stop using the platform at any time.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where superseded by federal law, including the FCRA.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of PreHireBadge after changes take effect constitutes acceptance of the revised Terms.
