FCRA Authorization & Your Rights

PreHireBadge is a consumer reporting agency under the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq. Every background check requested through our platform follows the FCRA's disclosure, authorization, and adverse action requirements. This page summarizes how that process works and the rights it gives you as a candidate.
Before a report is run
- You must receive a clear, standalone written disclosure stating that a background report may be obtained for employment purposes.
- You must provide written authorization before any report is requested.
- The employer requesting the report must have a legitimate, employment-related reason for the request.
If a report leads to a negative decision
If information in your report may lead an employer to deny employment, rescind an offer, or take another adverse action, the employer must follow a two-step process before finalizing that decision:
- Pre-adverse action notice — you must receive a copy of the report and a copy of the Summary of Your Rights Under the FCRA, along with a reasonable opportunity to review and respond before any final decision is made.
- Final adverse action notice — if the employer proceeds, you must receive notice identifying PreHireBadge as the consumer reporting agency, confirming that we did not make the hiring decision, and explaining your right to dispute the report and request a free copy within 60 days.
Your rights under the FCRA
- The right to know when a background report is being requested about you.
- The right to receive a copy of the report used in an employment decision.
- The right to dispute inaccurate or incomplete information directly with PreHireBadge, free of charge.
- The right to a reinvestigation of disputed information, generally completed within 30 days.
- The right to have corrected or deleted information sent to anyone who received the inaccurate report in the prior six months, upon request.
- The right to sue a consumer reporting agency or employer that willfully or negligently violates the FCRA.
How to dispute a report
If you believe information in a PreHireBadge report about you is inaccurate or incomplete, contact us using the information below. Include your full name, the employer who requested the report, and a description of the specific information you are disputing. We will reinvestigate and respond within the timeframe required by the FCRA.
